credit cards
December 13th, 2007 by Questions
Hi there,
I have owed some credit cards and student loans, and thinking of going to bankcrupt. However, on some credit cards, I have zero balance. My question is: if I go bankcrupt, can I keep the credit cards that have zero balance, and use them after I finish the discharge period(9 months)? please advise.

No you would not be able to keep any of these cards. When you file for bankruptcy you are requred to turn all credit cards over to your trustee.
There are two exceptions, the first is if the cards are not in your name and the 3rd party whose name they are in agrees to allow you to keep the card. The othere exception is if you are able to obtain written permission from the the credit card company that they agree to allow you to keep this card and then provide this documentation to your trustee.
