A garnishee is one mechanism available to any unsecured creditor to collect on outstanding debts. Most creditors, not including Canada Revenue Agency, must first take you to court to obtain a Judgement. The court will normally award a judgement to the creditor if the judge decides that the creditor’s claim is valid. Every judgement is enforceable for 10 years and it can be renewed until the associated liabilities are paid in full. Once a judgement is obtained the creditor must apply to the court for a garnishee summons from the court and delivers it to your employer or financial institution. This garnishee summons give the creditor the legal ability to seize wages or money in your bank account, up to the amount of your total judgement debt plus legal costs.
