with power of attorney ..declare bankruptcy?

i am the power of attorney for my mother. Currently, she is depressed and suffers from a history of other medical problems. She is on heavy medication, and currently her doctor has suggested she take a year off work. She is self-employed and we are not sure if her insurance company will consider her ailments as a “disability” and pay out the monthly benefit. If they do not pay she will have no choice but to declare bankruptcy as she has no income. Am i able to attend all sessions with the trustee? Do i play any role in verifying information as her memory/thinking is also affected with the medication?

By definition, by holding your mothers power of attorney, you should qualify as one eligible to file a bankruptcy on your mother’s behalf. As such it would be you who would be responsible to verify all information to the best of your knowledge on your mother’s behalf. I suggest you contact a licensed trustee and they will be able to advise you as to what you would actually be required to do.
