Joint Bankruptcy with surplus income

If my husband and I declare joint bankruptcy and we have two children what is considered… no examples included both joint and with children our joint monthly income is 3400 Approximately we both have irregular shifts and can make more or less in a month

Both of your income would be used to determine if you any surplus that needs to be paid. So you take your $3400.00, subtract off the amount that is allowable from the 2009 surplus guideline for a family of 4 ($3474.00). As you can see right off the bat your income is less than the amount allowable, as a result the likely won’t be any surplus that needs to be paid.
