Canadian bankrputcy laws (the Bankruptcy and Insolvency Act of Canada) specifically exclude Court Ordered payments for spousal and child support. If a Family Court as Ordeed you to pay your ex-spouse’s Court costs, this is a debt that may be included in bankruptcy, BUT you should expect your ex to return to Family Court and ask for an increase in their support payments to cover the extra amount they had to pay. You should talk to your lawyer about this before you decide whether or not it makes sense – bankrputcy is not a good strategy to avoid Family Court Orders.
