Consumer Proposal & Tax Refund
June 28th, 2012 by Questions
I requested an adjustment of my previous income tax returns a while ago and may receive a refund very shortly.. I have just filed a consumer proposal….if I receive a refund before the 45 day period, to whom does the refund, if any, belong???

As long as you have already disclosed this to your trustee, they are aware of these pending income tax refunds and the proposal was offered with these in mind, then the returns are yours to keep. However, if this was not discussed with your trustee you must call him/her immediately as this needs to be reflected otherwise the proposal could be considered null and void as it was based on inappropriate information.
