Court Claim and Consumer Proposal

I have been considering a consumer proposal for some time now but haven’t had the opportunity to gather all my documentation and make an appointment to see a trustee. One of my creditors has just filed a claim with the Ontario courts for the debt I owe them and I have 20 days to file a defence. Is it too late for my consumer proposal now?

No, in fact, you can even file a consumer proposal after teh Court issues an Order against you for this debt. Having said that, the sooner you put a stop to the process the better – if you let the creditor run up legal costs when you knw you are going to file a proposal the Court can hold you responsible to pay those costs.
