Surplus Income

I was paying $225 a month to my trustee since last October and had to lower my payments to $100 in July because I could barely pay my bills. I just looked online to see if the surplus income amount has changed for 2011 and I see that if I’m making less than $200 surplus income…I may not have to pay and can be discharged? Am I totally confused or is it to the discretion of the Trustee? Your reply is much appreciated as I’m still having trouble at $100 a month.

You will need to discuss this with your trustee. We don’t have sufficient information to be able to answer this questions properly and the answer will depend on the exact amount of your income in each of the months that you were in the bankruptcy. Without that it would simply be speculation. So discuss this with your trustee.
