truck driver

September 6th, 2011 by Questions

In 2010 I found I had bladder cancer. At the time I had a Tractor and trailer and drove all over North America. I was a bit behind in payments, and working with creditors to solve. Besause I had to be off work for surgeries and treatment. I had no income other than disability, and I had no disability on truck and trailer load. I went bankrupt in Nov of 2010. I started working for someone else in April 2011. I have surplus income. I want to buy an old truck and get back working for myself. Can I get out of bankruptcy? My truick and trailer were sold by creditors, but they made an error when registering and the trustee now holds the trailer. the same creditor holds my mortgage since 2005 ( never missed a payment) Trustee wants me to remortgage due to the same registry problem with Creditor. I can’t remortgage (I’m bankrupt) Trustee even give me a mortgage broker’s card to call. Trustee told me (verbly to stop paying my mortgage and I would be reimbursted the payments since Nov. 2010. What can I do? Confused

Unfortunately this is a question that I am not in a position to be able to answer. I can definitely see why you are nervous to simply stop paying your mortgage. But the best thing for you to do is to schedule a meeting with your trustee to get a more thorough explanation of what is happening. But without knowing all the details of what has happened with your creditors to date, I simply an not in a position where I have sufficient information to understand what is occurring, nor do I have the ability to advise you about what specific action you need to take at this time. If you are not able to fully understand what is happening you could also try to contact the local Office of the Superintendent of Bankruptcy and they may be able to assist with clarifying things for you.
