Joint secured loan – divorced

I have a joint loan with my ex-husband. The loan is secured by his motorcycle and all payments are made on time and come from his own personal bank account. We do not speak as the divorce involved the police and a restraining order. I would like to know how to file bankruptcy avoiding the inclusion of that loan.

As long as your name is associtaed with this debt you will be required to include the debt on your list for bankruptcy purposes. If you don’t want to list it then you need to speak to your ex and get them to have your name removed from the loan. I recognize that you told me about the restraining order, but the only way to get your name off the loan before you file for bankruptcy is to have your ex call – or pay off the long completely. Sorry.
