May 9th, 2011 by Questions

My wife has some substanial debts (student loan and unsecured) after going to school. She has been on disability for almost 5 years now and I am currently in school and dependent on student loans. If my wife declares bankruptcy will it affect my ability to be recieve student loans for school in the future?

As long as you have not signed on your wifes debt, there really shouldn’t be a great deal of impact on you, even if she files for bankruptcy, her debts are hers and marital status really doesn’t change that. Now you may find that you have to assist her when it comes to completing some of the duties she will have in a bankruptcy, but your role will be limited.
