Can a collections agency petition against my bankruptcy and still make me pay my debt plus the trustee fee\’s?

Any of your creditors has the right to “oppose” your discharge from bankruptcy whihc means a hearing will be scheduled so that a Court may review your file.
It is a fairly common threat by collectors to tell you they don’t care about your bankruptcy and/or they will oppose and get a Court to order you to pay them off. It’s a hollow threat. In the 25,000 cases that our firm has handled I have never seen a collection agency oppose someone discharge – they are simply trying to scare you into making some kind of payment.
By the way, if you do make a payment to a creditor after you file for bankrutpcy it can get you in a lot of trouble – don’t do it. In fact, if this company calls again take their information down and call your trustee so they can speak to them….
