If you are actually found guilty of fraud then the debt, the fines and the penalties will NOT be dischargeable by bankruptcy. If they don’t call it fraud, rather an error, then the interest and penalties can be dealt with. Once the government completes their audit you can ask them whether they called it fraud or not. You have the right to contest a finding of fraud (but that takles money and a lawyer so it is not done very often).
