location during the 9 month period

June 10th, 2009 by Questions

Do you have to remain in your province or even in canada during the 9 month bankruptcy process before you get discharged? I dont mean being away completely for the whole 9 months but if you had to be away for 4-5 months out of canada, is that ok?

You do not have to remain in the province or the country when you file, BUT there are 3 or 4 personal appearances you MUST make during the 9 month procedure. If you are going to travel then you should get these appearances out of the way first. In addition, there is a monthly reporting requirement that you must comply with – your trustee won’t care where you are, but you still have to perform all of your duties if you want to be discharged.
