spouse unemployed

my husband was self employed now unemployed. i work as much as can to keep paying the 1800 month mortgage payments. We probably have to claim bankruptcy. We`re about 100000 in debt due to loans & credit cards. we have 3 kids and he tries to make child support payments to someone else. due to our hardships he was in arrears and keeps losing his license which is now even harder for him to find a job since he is a truck driver. I heard the MEP arrears are not covered in bankruptcy. And if hes not working am I responsible to make his bankruptcy payments? I know myself I`m going to have difficulty making my own.

You are right that MEF arrears cannot be cleared by a bankruptcy, but the bankruptcy may allow you to free up money you are spending on other debts to make this one more manageable.

Now while your spouse is not employed the cost of a bankruptcy may be difficult to cover without your assistance, but you are really best to discuss this with a local trustee.
