My Common law Spouse claimed Bankruptcy, not me. then he passed away. Can the trustee take my Tax return and my common law spouses as well?

If you common law spouse claimed bankruptcy, regardless of his passing, the refund will be paid into his trustee. However, if you didn’t file bankruptcy the trustee shouldn’t have any reason to receive or keep your refund as you weren’t the one in bankruptcy.
