Student Loan – bankruptcy

September 28th, 2007 by Questions

It has been 10 years since I received my last student loans; I attempted to make some payments but the bank returned them stating it was not the right amount – it was what I could afford at the time; now they have placed a judgment on my credit in Canada – I live and work in the US – with no intention of living in Canada – can I file bankruptcy in Canada? Please help!

You likely cannot file bankruptcy in Canada unless you have resided here within the last year or own property in Canada.

However, with not intention of returning to Canada there is very little liklihood of your creditors doing much to collect accross International borders so you likely won’t have to do anything.
