Can we file consumer proposal individually

If my common-law spouse and I have a mortgage together…can we file the consumer proposal individually? Also, if we filed jointly….since some credit card debt is through the same bank as our mortgage…will that effect our ability to renew the mortgage when it is time?

There is nothing in the legislation that requires you to file a joint proposal, so the choice between filing individually or together is ultimately up to you (assuming you have sufficient joint debt to qualify to file jointly).
In terms of credit card debt affecting the ability to renew the mortgage, while it is always possible, it is probably won’t have much of an impact. However, this is a question that is better asked of a mortgage rep at your local institution as these decisions will be largely based on internal policies and procedures.
