Lawsuit in Progress

Hello
I am currently in Litigation with a creditor who claims that I owe them a large sum money. I have been defending it because I believe I do not owe them. If I were to file for bankruptcy before the court date , would they need to be listed as a creditor since the courts have not ruled in their favor?

If you file a bankruptcy or proposal, depending on the specifics of this litigation, you would most likely be best to simply list the debt, not waste any more time or money defending your self as the debt would be cleared by bankruptcy. This is assuming that the debt is dischargeable by bankruptcy, to confirm whether it is or not you should contact a licensed trustee in your area and let him review any documents relating to this action.
