credit debt

December 18th, 2005 by Questions

Hi. My sister is currently planning to file for bankruptcy due to credit card debt. Her intent is to max out the remaining limit on her cards before she files. I know nothing about these issues, but that sounds like a really bad idea to me. Does anyone know what additional consequences, if any, she will face in executing this plan of hers? Thanks!

This is a VERY bad idea! The trustee reviews all use of credit in the months prior to bankruptcy automatically. They start with 3 months, but have the ability to go as far back as a year if necessary. The creditors (i.e. the credit card companies) will also scrutinize the account activity and any unusual can lead to those debts surviving a bankruptcy.
