Hello, my question is , my husband and I are legally separated and we own serveral properties. He is presently unemployed and he wants to file for bankruptcy. What does that do to me? Do I have to file ? Whom should I speak to?

Whether or not you have to file will depend on your own financial sitaution – just because your ex files that doesn’t mean you automatically have to file too.

The biggest issue will be any joint assets or debts. When your ex files his trustee has to recover your ex’s share of any equity that exists in the assets. That meay mean they have to be sold, unless you can afford to buy your ex’s share.

If you haven’t worked out a formal separation or filed for divorce you may want to talk to a Family Law lawyer to see what is required. It may give you some more leverage in your ex’s bankruptcy.
