seperated but not divorced

i am filing bankrupsy but I am not sure how I go about it as I am legally seoerated but not divorced.. can I assume all the debt or do we have to do it together

Your marital status makes no difference to the bankruptcy or to who is legally responsible to repay the debt. If both you and your spouse signed for a loan or other credit then you are both responsible to repay the debt. The only people that can release either of you from the debt(s) is/are the lenders. You can “assume all of the debt in a divorce”, but it is meaningless as far as the lenders are concerned – they may still collect from whomever signed for the debt.
