My corperation after Personal Bankruptcy

June 24th, 2013 by Questions

I filed for Bankruptcy in 2010, been discharged for almost 2 years now. I am still receiving Tax returns request for my old company I had when I filed bankruptcy. After a long conversation with Revenue Canada, I’m still no closer to solving this problem of the Company which I was told I would no longer be a director of. He stated i needed to supply them with a Change of Directors form. Anything you can guide me with would be so grateful…I really just want to move on from this…

Unless you also filed bankruptcy for the corporation, CRA has to keep sending demands for the corp to file until such time as they revoke your charter. This usually takes 3 years, but can take longer depending on the volume of work at CRA.

So, you will keep receiving letters and demands to file until the government decides to stop sending them… It’s part of the process – your trustee should have warned you this might happen (although, I know many trustees don’t since they aren’t representing the corporation).
