How walking away from home affects exes
March 13th, 2013 by Questions
My ex filed for bankruptcy 7 months ago. We have been separates for 14 months. The bank came after me for money owing on a joint account we shared that had my name on it, and I paid the money owing. At the time of his bankruptcy, my ex did not include his home in the bankruptcy. Now, 7 months later he has decided he is going to hand over the keys and just walk away from the home. My question is how am I going to be impacted by this? Will the bank come after me to pay off the owing amount on his house? It is under his name and only his name. And he owned it for 10 yeara before we met. We are not divorced, only separated.

If you did not sign the mortgage then you can’t be held responsible for the debt. If you did sign for the mortgage then the mortgage company will serve you with all of the documents you ex is going to receive when the mortgage company seizes and sells the house. If you are not certain whether or not you signed the mortgage, call the mortgage company and ask them – they won’t talk to you about the mortgage if you didn’t sign for it…
