I won a small amount in the lottery, but I went bankrupt 5 months ago

January 19th, 2012 by Questions

I won 10,000$ in a local lottery (scratch and win type deal) but I am still in the process of my bankruptcy payments being made.

Would I need to forfeit all winnings to my trustee in this case?

Yes, you would have a legal obligation to disclose this to your trustee and in turn you would in turn lose these lottery winnings. Failure to notify your trustee would be a serious issue and likely result in an overturning of your discharge (if one had been fraudulently obtained) and potentially the court refusing to grant a discharge.
