disclosure of previous bankruptcy

Is it against the law not to disclose a bankruptcy after discharge? after the r9 is off your credit report? if so what are the penalties?

If you are specifically asked whether or not you have a previous bankruptcy and fail to answer it correctly, this is considered to be fraudulent misrepresentation. This is a serious criminal issue. As I am a bankruptcy trustee and not a lawyer I am not familiar with the exact penalty, I do know that there are potentially fines and court time that can be attached to this type of charge. As a result you are best to simply disclose it.
