Inheritance After Discharge

October 28th, 2009 by Questions

I will be discharged from bankruptcy at the end of this week (uncontested, first time). I just got notice that I am entitled to a small inheritance but must fill out paperwork and wait for my brothers to do the same. I spoke with the (inheritance) lawyer, he thinks the earliest I would get the cheque would be the beginning of December (It`s now end of October).

Will I be able to keep this inheritance because I don`t actually receive it until after my discharge, or will I have to forfeit it because I received notice of it prior to discharge?

If you are aware of it now you are required by law to disclose it to your trustee. If you fail to disclose this you will have committed an offense under the Bankruptcy and Insolvency Act and create yourself some very significant problems. As the inheritance became available prior to discharge you will loose it as part of the bankruptcy.
