Bankruptcy and Property

August 26th, 2009 by Questions

My partner and I are thinking of buying an apartment with the mortgage under her name. If my name were to be added as an owner to the property before I am released from bankruptcy, would there be any complications? Or would it be better to wait to purchase after I am fully released from Bankruptcy?

This really depends on how much equity is in the property, and with out knowing those details it is difficult to advise what would be best. But if you are not putting any of your money into it and there isn’t going to be very much equity then there shouldn’t be any real problem with you purchasing it now. However, I would recommend you contact a local trustee and review the details of this transaction with them, as they would be in a much better position to advise you how to proceed.
