never discharged after 2nd bankruptcy

I filed in Nov 2006 and the file was closed in Dec 2008. Nothing was discharged because I didn`t have $5000 in the bank to pay CRA. I`m bankrupt! Included were student loans over ten years old. Will the bill c12 if it ever comes in, discharge those student loans or will I have to go for a third bankruptcy?

You should be able to apply to the Court to have the student loans included in your last bankruptcy retro-actively. The student loan provisions of C-12 were enacted last year – the exclusion period for student loans is now 7 years…
Contact your trustee to dtermine what has to be done in order to receive your discharge and to include your student loans. You should expect some sort of additional charge since your file was closed in 2008…
