We filed for bankruptcy in feb 08 and were released in Nov 08. The co we dealt with never had us sign a post bankruptcy form for income tax. Now they are after us to sign this paper releasing our 08 taxes to them. they are also wanting our t4`s for 08. Is this a normal process for them to be following? Thank you for helping. …….. Alberta

Unfortunately 2008 will be screwed up. On July 7, 2008 the government brought into force a portion of the new bankrutpcy laws that made your post bankruptcy refund an asset reliazable by your trustee – in other words as of July 7, 2008 trustees are entitled/required to keep your post bankrutpcy tax refund. The law doesn’t require your trustee to actually file the return, but most that I have spoken to plan on offering the servcie (since they’ll be getting the refund that is created). The really unfair part of this new law is that if you “owe” on your post bankruptcy tax refund you’re required to pay.

Don’t blame your trustee for this one – the government only notified the trustee community in March of 2009 of this change – many of us are understandably annoyed with the government’s lack of communication on this one…
