Discharge documents
November 20th, 2008 by Questions
Hypothetically, if I were to file for bankruptcy and was told that I should be discharged on say… Jan 15, 2009….
1) When would I get my discharge papers, in other words, how soon after Jan 15, 2009 would I get my discharge doc ?
2) From whom do I get the discharge papers ?
3) Do I automatically recieve it or do I have to request my discharge docs ?
Thank-you

The length of time you are in bankruptcy depends on how quickly you are able to complete your duties and responsibilities, the local court procedures, as well as a few aspects of your situation. However the soonest you could be out of bankruptcy is 9 months.
When you qualify for the discharge then your documents are prepared by your trustee, signed by the court, and once the proper signatures are obtained it would be automatically send to you by your trustee.
