no discharge in sight
« on: June 29, 2010, 08:19:48 AM »
My husband and I declared bankrupcy in 2007, did our best to pay the surplus and keep a roof over our heads, needless to say we ended up having our bankrupcy extended to finish paying the trustee. According to the trustee they filed for our discharge in March and now we are entering July and no word on the discharge. We asked the trustee to enquire about the statis on our discharge and they said they don't do that. Can someone tell me how long this should take, or does the trustee have a responsiblily to follow up on the discharge after a certain amount of time after filing for the discharge. We feel like we are caught in limbo with no where to go.

Depending on which court jurisdiction you fall under, the wait time can be anywhere from 6 months to a year. The trustee will request a date, and they get what they get from the courts.

Good luck

Does anyone know just how long or if there is a set amount of time that a trustee has to file for discharge when all requirements ordered by the court on a conditional discharge.

As suggested by my trustee, I went to the court (in Toronto) myself and asked them when I could expect a court date. I had to wait 5 months after my last payment to trustee to get into court for my discharge hearing
