  ??? I have just entered Bankruptcy and was wondering if this would hamper my JCPenny Card in the States. I did not owe anything on it. and did not mention it in my bankruptcy, I have no intentions on using it but was wondering if it would be effected.

My Advice , declare that card & move on. You dont want to be considered untrustworthy nor fraqudulent in any way during your course of BK.

Also , if you read your contract & info regarding BK , its stipulates you cannot apply for a credit card , nor use one that has not been declared. This is considered fraud to some degree.

Therefore , get rid of it  declare it.

ML, that would be my advice as well. Someone else said that he/she had a cc which was not declared during the BK or CP, it had a zero balance. The person's trustee said that it would be fine to use it as it was not part of the BK/CP.

Wonder why the conflicting information re: use of credit cards while in a BK or CP?  My Obligations very clearly state that I must hand over all credit cards in my possession, in my name. It doesn't say that I can't use one....but I suppose that's a presumption. How can I use one in my name if I don't have any??  Undecided

I know that credit card companies do periodic credit report reviews and perhaps once they see that the person is in a BK, the credit card will be revoked. I don't know   Huh

I understand the in a Bankruptcy you must declare and destroy all credit cards. In a proposal there seems to be a Grey area and different trustees say different things. It would be nice if a few trustees would chime in here.

I don't know how 'gray' the area is. My Obligations under my Consumer Proposal are statutes in law...that clearly state that I must declare and turn over all credit cards in my possession, in my name.  There is no grey area in that wording. Even if the cards are US or Canadian or other foreign...they are credit cards with my name on them, and in my possession. What if my mother had some of my credit cards...well....they're not in my possession...but they do have my name on them!!!   Cheesy  Perhaps, that's the grey area.

Some folks have Trustee's who refuse to allow them to get secured credit cards,  I've read about that. One sometimes needs a letter from a Trustee to get a secured credit card.  I don't know how my Trustee thinks about this, I didn't ask him.
I do know that I'm allowed to have a prepaid Mastercard. I do have one, and I have used it. I asked first, and it doesn't break any of my CP rules.

It would be nice if someone with expert knowledge could give more insight into that 'rule'...!
