Hello, here's our story. Hoping someone has some encouragement.
I am filing a CP tomorrow for my debt load which consists of credit cards and a joint line of credit. It's with CIBC (loc) more then 60% of all my credit is...so they have majority vote. I also hear they are tough! Sad ok, issue is...what happens with my LOC? They will tell hubby he is responsible to pay? Hubby has been bankrupt 10 years ago and also will be doing a CP after mine is approved. We are worried about what CIBC will do once they find out of his CP? Will they force 2nd bankrupcy? The LOC is up to date because we are scared they will make it deposit only $700 payments monthly, instead of just interest we pay now $150. If hubby gets full responsibility of LOC and it becomes deposit only then the reject CP we will be forced into 2nd bankrupcy because we can't afford $700 payments a month. So stressed! Can anyone relate to this one?

We did soemthing similar in 2010.  I filed first and three days later, my sprouse got a letter saying that our line of credit was no longer available and to keep making the minimun payment and everything would be ok.  Due to other problem, my spouse filed two months later and they (BNS) accepted the second proposal.

If you offer more than what they would get in a bankruptcy they usually accept.  CIBC had 15% vote in mine and they accepted.

Any specific reason you are nopt filling together?

Thanks for this! My Trustee said that because a he's been bankrupt before and the loc is joint and CIBC is the control, it's best to let them think my hubby will make payments so they agree to mine. Something like that, she seems to know what she's doing so hoping for the best!

I know how you feel.  I followed my trustee advice and it worked well, so I hope that it all goes well for you too!
