I have an $1800 overdraft at a bank.  This bank account is a joint account with my husband.  He does not want to claim bankruptcy and has since moved all his direct deposits and bill payments to another bank in his name only.  I have to claim bankruptcy as I owe approx. $58,000. which includes a $10,000 line of credit with the bank where the overdraft is.  Due to an enormous amount of family problems, this $1800. is impossible to replace at this time.  Creditors are calling and collection agencies are calling and I must make a decision soon. Is there anyone else out there that has a problem like this?  Also, when I went to another bank to open a new account, they said they have to do a credit check.  That being said, I didn"t open an account because at this time, my credit is terrible and I felt that the bank would refuse to open an account for me.  Huh? Embarrassed

Could expand on the 'problem', please.  I'm not understanding what you're saying.  Do you mean that you have to claim bankruptcy because of an $1800 overdraft?  Or, you owe nothing on the overdraft and want to keep it after filing for bankruptcy?

Thanks,
