I tried the consumer proposal and it was rejected so my option is bankruptcy. I am concerned about our home that has no equaty all up to date and will continue. I have 4 in the family with my wife and I as wage earners making abot $3990per month, Her wage is $1400. per month clear, There is a pro rated factor I can not grasp at all but think it would represent 40% of her wage so that together with mine is under the income allowed for family of 4 and yet the trustee states payments for $200 a month. How long it was 9 months then could chage but what is it based on these income figures. The trustee does not seem to have compassion. There is a chance for some spontainous work that could give me clear $600 extra a month but not regular and case by case it could happen. How much of that do I see in my family use.

Dear help:

The $200 per month that the Trustee told you about is called surplus income payments, which, is driven by a formula calculation from the Superintendent of Bankruptcy.  The Trustee has no latitude or decision making.  You referenced having to make payment for 9 months, but, that was under the old, pre-Sept 18, 2009 rules.  Now, as a first timer, it will be 21 months.

The thing you don't state is what your main creditors wanted for you to amend your Consumer Proposal so they could accept it.  If all that happened is that they did not accept it, as opposed to you having failed to make all the payments, there may be a chance to file another Consumer Proposal that will meet their needs and yours.  Otherwise, you are right, it is bankruptcy.

Why would the trustee say 9 months and the $200.00 per month is the trustee fees. The first month to report things is April so any income from January to April does not fall into this income. CORRECT/ Does payment for filing income tax which is for spouse and I plus company was $500.00 which will be paid in April Is this a business expense. My company is closed down, web-site gone etc. I have some small consultation job not related to the old company business and I made 7 hours last weekend so is this reportable as it is before the April start? If no surplus income then no 21 months just 9 months? Correct?

You are generally correct.  If you have no surplus income, then the 9 mos. of payments is only to pay the Trustee's fee.
