<p>they are having trouble making monthly payments for insurance, condo maintenance fees, car payments and mortgage. i work full time and i try to helpl them out. recently i decid to pay off their accumulated property tax. i have my own student loans to pay off so i dont think i can help minimize their debt.</p>
<p>woold filing for bankrupty their best option? and if they do, will the they lose their home?  the home is under my dad, my mom and my name.</p>

Can&#8217;t get an equity loan on house because she&#8217;s on title of house. Can I declare bankruptcy? If I can, what happens to my house in Alberta?<br />

			<content:encoded><![CDATA[<p>I consulted a trustee and expressed a profound concern that my current car, which is 10 yrs old and in very bad shape would not pass the new inspection laws in 2012. But that by being in bankruptcy, I could never get a loan for a new car. Without a car, I could lose shared custody of my daughter because I couldn&#8217;t take her to school (another city than residence).<br />
She said to purchase a brand new car before filing bankruptcy because it would last the duration of my bankruptcy and if I keep making all those payments in full, a law passed in 2009 says that the bank that is financing the purchase cannot take it away if payments are respected. &#8211; Is this true ? What law states this ?</p>

We have racked up debt trying to take care of the problem on our own this past year and now can hardly afford to buy food so we have to stop our mortgage payments.  We are currently living in my fathers house and he passed away last year and left the house to me, however we have not transferred title or sought probate yet as we cannot afford to.  We are considering bankruptcy but I am afraid they will take my fathers house and force us to sell it, leaving us with nothing. Any advice on the matter would be greatly appreciated. </p>

My husband is thinking of filing for bankruptcy, as we have gotten into trouble with credit cards.<br />
We currently have 2 vehicles. A mini van, which I use and a car my husband uses for work. The car is paid for and we are still paying for the mini-van, payments are up to date.<br />
If he files will we have to give up one of these vehicles? They are both in his name. I am a stay at home mom, but need my vehicle to take my kids to school and other appointments and he has to have a car to get to and from work.<br />

I own a car paid off  not worth much (2006)dented and dinged up. Is Personal Bankruptcy even an alternative or would I have to give up my home and my car thereby leaving me homeless and unable to make doctor appts etc. thankyou</p>

I just make enough money to servive and pay my basic bills. i make about 1200-1400 a month on min wage jobsand i have no spare cash. I am common law right now so I am wondering how much money I can make? also my account is in a different bank then the debts. what do I do?  </p>

It is my understanding that the bankruptcy will take all refunds I have owing on my past 5 years of unsubmitted and unrefunded taxes.  I am on disability and money is very tight.  When things were a bit better I had private health insurance.  It used to be a significant portion of my refund.  I am wondering if when I give in my income tax info to the bankruptcy people if I were to leave out the insurance receipts, whether I could go back and claim those at a time when I could legally have the refund that would be the result of those receipts.  I realize this may not be ethical to hold back the receipts but is it illegal?  I am, after all submitting them, just later.  I believe one can go back and submit  to Revenue Canada things &#8220;missed&#8221; in past income taxes?</p>

Now I have received a cheque for a huge lump sum from the back payment of the child tax benefits. How will this affect our bankruptcy payments? Will we owe any of that to the trustee? You mentioned somewhere that it would be considered income, how do we adjust that on our monthly expense reports?<br />

We had very poor bookkeeping and while settling our divorce the books showed a huge debt to the Government, banks, and some suppliers ($110,000) I have personally treid over the last 2 years to keep the company afloat and have borrowed $40,000 of my own money to keep it alive. I am on a payment plan and have almost paid Gov but Visas and line of credit are still overwhelming. If I was to consider bankruptcy, which way do I go corporate or personal or both? We have approx $170,000 still in trust from the sale of our house, is that affected?</p>

			<content:encoded><![CDATA[<p>Im thinking about going bankrupt. I was without a job for a while and accumulated or 40k in credit card debt. I can no longer afford the credit card payments , but I have a boat and trailer that are financed through a local credit union. </p>
<p>I am wondering, if I go bankrupt, will I have to give up the boat and trailer? Or can I keep them if I can afford those payments? Really the only thing that is killing me is the credit card payments, I have considered a consumer proposal, but  I think bankruptcy is the option for me in this case. </p>
<p>Would I be able to keep the boat and trailer if bankrupt, if I was able to keep making payments to the bank on them?</p>

We went to court and made a settlement on my payment for $350 per month and I gave bank the authority to sell my home if I do not pay that monthly payment (My home has equity like 30k). Now I have calculated and found if I claim bankruptcy I should pay 200 per month to trustee and also all my debts which are equal to 90k (including that 60k) will be gone. I want to know if I claim bankruptcy and stop paying the $350 to bank and start paying $200 to trustee, can they still sell my house because of that court permission or bankruptcy law will protect my home from it.</p>

Now I find myself in way too much debt and am considering CP or bankruptcy.  I know an RESP is an asset that can be liquidated in a bankruptcy.  Is it worth it to wait another two years until my son can use these funds for his education?  I`m still able to pay my minimum balances on all my credit cards.</p>

<p>Can the trustee, debt agency or someone go into the home to look around and take whatever they think has value? For example a $500 couch they think is worth $6,000 if they see it. A computer worth $3,000  (at that time new) but now its worth $300 or a picture that looks old. What if it`s an heirloom? A Big screen LCD TV that has a crack or doesn`t work.</p>

			<content:encoded><![CDATA[<p>I did my mom`s finances recently after my dad`s death. Between her and the joint accounts between them, she now would have about $53000 in debt, a minimum payment of just a touch over $1500 a month on a $1100/month income. This doesn`t include bills and such.</p>
<p>The house was between me and my dad, so the house would transfer over to my name. There`s a considerable amount of tools and personal effects in the house and if my mother declares bankruptcy, would these items be brought into question?</p>

<p>I was told that the money was locked until I turned 55 or under a hardship claim I could take out a portion of this pension money.</p>
<p>My question is: If I were to declare bankruptcy, would this pension money be protected like moneys in an RRSP (after a 1 year holding period) or would creditors be entitled to those monies?</p>

I`m 70 and I just lost my job.  I was living paychq to paychq and I`m 40K in debt.  I want to claim bankruptcy.  I owned a 2005 Dodge Caravan with 200,000 km and 2 accidents (fixed) damage to front and side (claims made).  I want to find another job, but I will need my van to do that, and to work if I can get another job.  Will I have to surrender my van?  How will I continue to look for work/work if I can get another job at my age if I do??</p>

We would definitely need a cosigner and have one.  We just don`t want this person in trouble.  They know we have been paying for a vehicle anyway and will continue.  We also don`t want to go to the trouble of purchaseing a vehicle with a cosigner when it will be taken away.  Will it?</p>
