When looking at claiming bankruptcy or a division 1 proposal-do you have to pay a fee up front or is there a payment plan???

The decision whether or not to require an “up front” fee is completely at the discretion of the trustee you are dealing with. In our practice it is not done, but it is not uncommon in the industry. Keep in mind that this up front fee must be disclosed and reported as part of the bankruptcy or proposal process.

Sometihng to avoid is/are debt consultants. These are folks that are NOT licenced trustees. Any fee you pay to a consultant will not be applied to the cost of your procedure – it’s simply a charge to talk to someone before you speak to a trustee.
